Privacy Policy & Candidate Data Covenant
01. Scope & Philosophical Commitment
At Human Code of Hiring ("Human Code", "we", "us", or "our"), operational under the domain
https://humancodeofhiring.com/, our foundational ethos states: "We do not use technology to surveil or replace people; we use autonomous perimeter engineering so people can work at the peak of human dignity."
This Privacy Policy governs our autonomous Edge Airlock, sub-180-second CDL-A voice concierge qualification system, and carrier recruiter portals. It explicitly details how candidate information, carrier client fleet assets, and visitor network telemetry are processed, protected, and cryptographically verified.
02. CDL-A Commercial Driver Applicant Data Architecture
Commercial truck drivers are the essential bedrock of continental commerce. We recognize the sensitive nature of commercial driver credentials, Motor Vehicle Records (MVR), Department of Transportation (DOT) medical cards, and employment histories.
A. Categories of Candidate Data Ingested
- Identification & Contact: Full legal name, verified mobile phone number, personal email address, and home zip code corridor.
- Commercial Driving Credentials: Commercial Driver's License (CDL) class designation (Class A / Class B), issuing state jurisdiction, years of verified tractor-trailer experience, and endorsements (HazMat, Tanker, Doubles/Triples, TWIC).
- Operational Fit & Logistics Preferences: Preferred freight routes (OTR, Regional, Dedicated, Local), home-time requirements, flatbed/reefer/dry-van experience, and operational availability.
- Traffic & Safety Disclosures: Self-disclosed DOT violations, moving violations, or accident history within the past rolling 36 months, processed strictly for preliminary carrier matching before official FMCSA Clearinghouse and PSP verification.
B. Carrier Transmission & ATS Handoff
Candidate data is collected solely on behalf of the commercial motor carrier with whom the driver intends to seek employment. Upon verified completion of our conversational pre-qualification screening, records are transmitted via TLS 1.3 encrypted REST webhooks directly into the designated carrier's Applicant Tracking System (including Tenstreet, DriverReach, Bullhorn, or WorkHound). Human Code of Hiring never sells, rents, or commercializes driver lead data to unauthorized third-party brokerages or job marketing aggregators.
03. Volatile RAM Execution & Complete Biometric Exclusion
Unlike surveillance-driven recruitment technology or persistent facial/voice profiling databases, Human Code of Hiring enforces strict zero-persistence physical isolation:
Human Code of Hiring DOES NOT extract, analyze, process, catalog, or store biometric identifiers or biometric information as defined under the Illinois Biometric Information Privacy Act (BIPA 740 ILCS 14/), Texas Business & Commerce Code § 503.001, Washington RCW 19.375, or California Civil Code § 1798.140. We specifically do not record, calculate, or preserve voiceprints, vocal tension models, facial geometry, retina/iris scans, or behavioral gait metrics.
A. Sub-500ms Volatile RAM Audio Processing
During the optional 180-second voice qualification screening, audio streams are processed in transient, volatile Random Access Memory (RAM). The speech-to-text pipeline extracts only alphanumeric semantic answers (e.g., "Yes, 3 years Class A OTR experience, clean MVR"). Once the text transcription is parsed, raw audio payloads are purged from server execution buffers immediately.
B. Absence of Wiretap / CIPA Pen-Register Liabilities
Our Edge Airlock operates strictly on technical payload verification (packet signature, TLS handshake cadence, client TCP window fingerprinting). We do not record or intercept communications between website visitors and third parties without explicit authorization.
04. Cryptographic SHA-256 Verifiable Proof Receipts
To substantiate our 100% Commercial Performance Guarantee and provide carriers with irrefutable proof of bot interception without maintaining personal driver dossiers, the system generates immutable cryptographic proof tokens:
These receipts verify whether an inbound application was a legitimate human commercial driver or an automated synthetic script, without exposing PII (Personally Identifiable Information). Proof receipts are retained in tenant-isolated encrypted ledger tables for 90 days for audit and billing verification.
05. NYC Local Law 144 Compliance & AEDT Independent Auditing
New York City Local Law 144 governs the use of Automated Employment Decision Tools (AEDT). Human Code of Hiring complies rigorously with all statutory standards:
- Non-Discriminatory Screening: The Human Code platform does not rank, score, or reject applicants based on race, ethnicity, sex, gender, age, disability, national origin, or protected demographic traits.
- Objective Qualification Filters: Candidate routing is governed exclusively by objective, carrier-dictated regulatory criteria (e.g., active CDL-A license status, verifiable operating experience, DOT physical certification).
- Annual Bias Audit Notice: Carrier clients utilizing AEDT features in New York City are provided with certified annual independent bias audit reports and impact ratios across protected groups.
- Advance Notice & Opt-Out: Where mandated, candidates receive clear advance notice of automated pre-qualification tools and maintain the absolute right to request an alternative manual recruiter review pathway.
06. California Privacy Rights (CCPA / CPRA) & "Do Not Sell My Info"
Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CPRA), California residents maintain fundamental privacy rights:
- Right to Know & Access: You have the right to request disclosure of the specific personal information collected and shared with your target carrier.
- Right to Deletion: You may request complete erasure of your contact and application records from our system.
- Right to Correct Inaccurate Personal Information: You may update your CDL-A experience or contact details at any time prior to carrier interview.
- Absolute "Do Not Sell or Share" Guarantee: Human Code of Hiring DOES NOT sell, monetize, or exchange personal information for monetary or other valuable consideration. We do not share candidate data for cross-context behavioral advertising.
To exercise your CCPA/CPRA rights or submit an erasure request, email our compliance officer directly at privacy@humancodeofhiring.com or utilize our Compliance Request Form.
07. Enterprise Carrier Security & Tenant Isolation
Enterprise carriers entrust Human Code of Hiring with recruitment velocity and candidate pipeline security. We enforce defense-grade security protocols:
- Encryption Standards: AES-256 encryption at rest; TLS 1.3 encryption in transit with Perfect Forward Secrecy (PFS).
- Logical Tenant Isolation: Every carrier operates in a cryptographically isolated tenant namespace with unique encryption keys and segregated telemetry tables.
- SOC 2 Type II Alignment: Infrastructure hosted within SOC 2 Type II and ISO 27001 certified edge data facilities.
- Incident Response & Breach Protocol: In the event of a verified data breach affecting carrier records, written notification will be delivered to affected clients within 72 hours of verification.
